on the 28th. day of June 1844 Personally came before me a Justice of the peace within & for said , James C. Owens and after being duly sworn deposeth and saith that he met this side of , when asked him if he had been at and deponent said, No! but nigh towards it.— asked if they had the bodies of Joseph & deponent said yes! asked if was also along with them deponent said No! to which John replied I’ll be damned if he ever gets back alive. deponent said he was sick to which replied if you knew what I know you would know more than what you do know now, and your affiant saith No further.
