Know all men by these presents that we the undersigned Asa D. Brashear and are held and firmly bound unto Joseph Smith Jr , and in the sum of one hundred dollars for the payment of which will and truly to be made we bind ourselves our heirs executors and administrators jointly and severally firmly by these presents given under our hands and seals this 13th. day of March 1839.
The Condition of this obligation is such that whereas is about to commence his action or in the Circuit— Court with against— Joseph Smith Jr and Now therefore if he Shall prosecute his said suit with effect and without delay and shall pay to the defendants and all garnishers all the damages that they may sustain in consequence of said attachment then this obligation shall be void else to remain in full force and virtue.
