KNOW ALL MEN BY THESE PRESENTS, That We Joseph Smith Jr & of the county of and State of held and firmly bound unto Benjamin B [R.] Wescott of the county of and State of his heirs and assigns in the sum of nine hundred dollars for the payment of which well and truly to be made we bind ourselves, our heirs, executors and administrators, firmly by these presents.
NOW THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, that whereas, the said Joseph Smith Junr & have this day sold unto the said Benjamin T Wescott a certain lot of ground situated, lying and being in the county of — and State of , and described on the plat of the Town of as being Lot No. two in Block No. twenty six and received in payment for said lot four notes of hand bearing even date herewith, for the sum of four hundred & fifty dollars, and payable as follows.
The first for 112 doll[ar]s & 50 cents on the 1st day of March A D 1842
The second for 112 dolls & 50 cents on the 1st day of March A D 1844
The third for 112 dolls & 50 cents on the 1st day of March A D 1846
The fourth for 112 dolls & 50 cents on the 1st day of March A D 1848
The fifth for 112 dolls & 50 cents on the 1st day of March A D 185
withThe interest for each and every note to be paid annually.
Now if the said Benj R Wescott his heirs, executors, or administrators shall well and truly pay or cause to be paid, the amount of said note with such interest as may accrue thereon, according to the tenor and effect thereof, when due, we the said Joseph Smith Junr & bind ourselves our heirs, executors and administrators, to make or cause to be made, a good and sufficient Deed for the above described lot and then this Bond to become null and void, otherwise to be and remain in full force and virtue.
