Joseph Smith was summoned to answer William Schwartz Edward Schwartz [Jr.], Isabella Schwartz, Eliza Schwartz, Eurasha <Horatio> Schwartz, Josiah Schwartz, Hiram Schwartz and Elizabeth Schwartz, of a plea of trespass and ejectment, For that whereas, heretofore to wit on the first day of October AD 1843, at and within the County of and State of , the said plaintiffs were possessed as of their own demisive in fee simple, of a certain tract of land situate at and within the said & , and known as the whole of the South East quarter of section five, town six North, Eight West, excepting six acres lying in the North East corner of the S.W. quarter of said quarter section, occupied and enclosed by , and excepting also one acre occupied by James Jeffs, lying in the South West corner of the South East quarter of said quarter section, and the said plaintiffs being then and there so possessed of said premises the said defendant afterwards to wit on the same day and year aforesaid entered into the said described premises, and from the time last aforesaid has unlawfully & withheld, and does now unlawfully withhold from the said plaintiffs [p.
