Appeal. This day come the parties by their counsel and are at issue &c and a Jury being called, come to wit: Thomas J[efferson] Rogers, Pheletus [Philetus] Hovey, Absalom Wells, , George King 1st. Levi Shepherd, Erastus Lanard [Larned], Anson Pease , Timothy Carter, Ralza[mond] Spencer and Joseph P. Cowles, who were duly empannelled and sworn:— And the havingfailed to no evidence being adduced by the in support of his claim, the Court direct that he become , and do consider that the deft recover against him the costs to be taxed.
