plaintiff in the abov[e] case having been first duly sworn doth depose and say on oath that he is in the above cause, and that he fears that he will not receive a fair trial of said cause in the Hancock Circuit Court in which the said action is now pending, because he avers, that the opposite party, the defendant in this suit has an undue influence over the minds of the inhabitants of the said where the said suit is now pending and that the inhabitants of said County of are prejudiced against this , so that he cannot expect a fair trial of said cause;— he therefore prays of this Honorable Court a change of venue in said case, as is by law in such cas[e] made and provided.
