there promised to pay the amount of said note to the said Ephraim S. Green according to the tenor and effect thereof
And for that whereas the said Joseph Smith deceasd in his lifetime on the twentieth day of March in the year of our Lord one thousand eight hundred and forty three for was indebted to the said plaintiff for money found to be due to <from> the defendant to the plaintiff on an account then and there stated between them
Yet the said Joseph Smith in his lifetime and the said John M. Ferris administrator as aforesaid after the death of the said Joseph Smith not regarding their said promises but contriving to <&c.> to deceive and defraud the said plaintiff in this behalf have not nor hath either of them as yet paid the said several sums of money or any or either of them or any part thereof to the said plaintiff (although often requested so to do). But to pay the same or any part thereof to the said plaintiff the said Joseph Smith in his lifetime wholy [p. [6]]
