Upon the complant of Joseph Smith against for the crime of Robbery and an assault with an intent to kill or Commit Great bodyly injury upon the person of Mr in s’d County of issued a warrant for the apprehention and arrest of Directed which was Duly Served and the had before me Const fees 31 cents Dec the 22d 1843 issued subpenas for & David Curry which was duly served by reading to the within named and David Curry Const fees 75 Cents issued subpena for and wife which was returned endorsed served by reading to the within: fees $1.00 cents Dec the 22d 1843 Parties present. Court called. Plead not guilty. and David Currey and and wife sworn and affter the proofs and alligations were heard prisoner was discharged for want of evidence
