aforesaid, with all the privileges and appurtenances thereunto belonging, or in any wise appertaining, unto him the said Elijah N. Freeman and his heirs and assigns forever. Provided always, that these presents are upon this express condition, that if the said his heirs, executors or administrators, shall pay or cause to be paid to the said Elijah N. Freeman his heirs, executors, administrators, or assigns the sum of three hundred dollars in manner particularly specified in three certain notes or obligations bearing even date herewith, and executed by the said , to the said Elijah N. Freeman as follows, to wit one note for one hundred dollars payable on or before the first day of April A. D. 1845. One note for one hundred dollars payable on or before the first day of April A. D. 1846. and one note for one hundred dollars payable on or before the first day of April A. D. 1847. said notes drawing interest at the rate of six per cent per annum from date, then and from thenceforth these presents and every thing herein contained, shall cease and be void, any thing herein contained to the contrary notwithstanding. This Indenture, made and entered into, this fourteenth day of February in the year of our Lord, one thousand eight hundred and forty-four between and his wife, of the county of and State of , of the one part, and of the county of and aforesaid, of the other part, Witnesseth, that the said and his wife, for and in consideration of the sum of one hundred dollars, to them in hand paid, the receipt whereof is hereby acknowledged, do hereby grant, bargain, sell, convey and confirm unto the said , his heirs and assigns forever, all that tract or parcel of land, situate and being in the County of in the State of , viz: The South one third of Lot Numbered two (2) in Block numbered nine (9) in ’ addition to . Together with all and singular the appurtenances thereunto belonging, or in any wise appertaining. To have and to hold the above described premises unto the said Orson Pratt his heirs and assigns forever. And the said and his wife, their heirs and assigns, the aforesaid premises, unto the said his heirs and assigns, against the claim or claims of all and every person whomseover, do and will warrant and forever defend by these presents.
