I do hereby certify <that> this is a true coppy of the procedings had before me on the 18th and 19th of September 1843 wherein is plantiff and defendant By oath of before Esq. cause of action brought before me for a ballance on an instrument of writing payable to $.78,84 cts dated April the 5th 1842
September the 18th parties met for trial Subpena isued for Joseph Smith sen and Wilkinson Hewett [Hewit] served by constable fees 56 cts by oath of for the want of material witness cause ajourned untill the 19th inst. at 12 oclock <19th> the parties met agreeable to ajournment demanded a jury venire isued to constable who returned it with the names of 12 men who after having heard the pleadings &c brought in a verdick as follows We the Jury find a verdick in favor of for the remainder of the within instrument except the interest with cost of suit Names of the jury R. Stephens James Jones Augustus Dodge S[epen] Blackman [I.] P. Rainy P. Allen L. Burklow I have therefore rendered Judgment against the for seventy two dollars and ten cents and cost of suit taxed at $.7,68 besides entering an appeal and this transcript which is 50 cts more so that the whole Debt and cost is $.80,28 Received of $.3,75 to pay Jury &c In testimony hereof I hereunto set my hand and seal this 20th day of september 1843.
