This day again came the defendants by his attorney and it appearing to the satisfaction of the Court that the said has failed to comply with the rule entered herein on yesterday requiring him to show cause why he should not be ruled to give security for costs by this morning Therefore it is ordered that the said rule be made absolute, and that this suit be dismissed for non compliance with said rule and for want of prosecution and that the said defendants have and recover of the said his costs by him in this behalf expended and may have execution therefor &c [p.
