<1> and the said defendants by their , come and defending the force and injury when &c and say that they are not guilty of the said supposed Trespasses above laid to their charge or any or Either of them or any part thereof in man[n]er and form as the said hath above thereof complaind against them and of this they the said defendants put themselves &c <by his Atty > <and the doth the like by his Atty >
<2> and for a furthr in this behalf as to the assaulting and as in his said mentioned and as to the imprisoning the said and keeping him in prison for the said time in the said declaration mentioned the said defendants by leave of the court say the ought not to have or maintain the aforesaid there of against them because they say that before and at the said time when &c in the said declaration mentioned the said Joseph Smith as Mayor of the city of orderd one to arrest one for a breach of the Peace under an ordinance of said City of passed March 1st 1842 and the defendants say that that said refused to obey the order of said Mayor [p.
