the said Commanding them to Summon and return without delay twenty four of like good and lawful men of the aforesaid for the purpose of enabling the said parties to Complete the said pannel.
Whereupon the said Elisors Summoned and returned into Court in obedience to the Command of the said writ, the following named persons as such Jurors, to wit: Isachar A Jones James Baird John McCauley Daniel Cain Erastus Austin Silas Griffitts Daniel B. Chapman James Cain Simeon Pennock Jonathan Foy Thomas D. Woolsey John Huckins William Printy Samuel Irwin William McKay Levi Doan Patrick Doyle Aaron Griffitts Thomas Ireland Jr James Irwin Henry R. Chittenden Henry Garnett Samuel White and Charles Comstock who being Severally called at the Bar, appeared, answered to their names; and gave their attendance accordingly— and thereupon the following named persons were mutually elected by the parties aforesaid and sworn upon the Jury to Wit— Silas Griffitts and Jonathan Foy and there not being a Sufficient number of qualified persons to Complete the pannel of the Jury by reason of the chalenges of the parties respectively as aforesaid It is ordered that a Venire Facies Issue to the said Elisors Commanding them to Summon and Return into court by 8 Oclock tomorrow morning twenty four of like good and lawful men of the County aforesaid for the purpose of enabling the said parties herein to complete the pannel of the Jury as aforesaid and there not being Sufficient time to Conclude the trial of this Cause on today It is ordered that the further proceedings herein be postponed until Tomorrow— Whereupon the said Jurors sworn upon the Jury as aforesaid to wit Jesse Griffitts William Robertson Joseph M. Jones William Smith Joseph Massey Silas Griffitts and Jonathan Foy were ordered by the Court to be kept together Separate and apart from all other persons and without Speech to any in Some private convenient, and comfortable place in the said town of by the said Elisors and that the said Elisors Cause the said Jurors to be furnished with such meat and drink fire candles and bedding as may be necessary for their comfort and Convenience and return them into Court at Eight Oclock tomorrow morning— to which time the farther proceedings in this Cause have been postponed— [p. 270]
