This day again came the parties by their attornies and also the defendants in their proper persons and at the same time also came and who were appointed by the Court as herein on yesterday and the said Elisors having accepted of their respective appointments were severally swo[r]n to support the Constitution of the and the Constitution and Laws of the State of and also faithfully and impartially to discharge the duties appertaining to their said appointments as Elisors and thereupon enteredupon the duties of their <said> respective appointments respectively— Whereupon It was Ordered by the Court that a Issue to the Elisors appointed herein as aforesaid Commanding them to summon and return without delay twenty four good and lawful men of the said County of for the purpose of enabling the said People and the said Defendants to make up the pannel of the said Jury of twelve good and impartial men as aforesaid and the said Elisors having returned into Court the Venire facias Issued herein with their return thereon in Obedience to the Command of the said Writ; Whereby It appears that the following named persons were Summoned to appear as Jurors in this case to wit James Carr Curtis Ingersoll David Grove Jeremiah Pearson James L. Kimball Simeon Walton Jesse Griffitts John Henry John Slater William Robertson James Welch Daniel Prentis William Smith Joseph Massey Allen McQuary Joseph Jones Samuel McConnell Uriah Thompson George Wade John Welch Hezekiah Cain Hiram Woodworth and Calvin B. Simmons who being called at the bar Severally appeared. Answered to their names— and gave their attendance accordingly and the said Defendants having been furnished with a copy of the Indictment and a List of the names of the Jurors aforesaid and also of the names of the Witnesses intended to be produced against them on the part of the People aforesaid on the trial: and being forthwith assigned and demanded of and Concerning the premises herein Charged against them in and by the said Bill of Indictment how they would acquit themselves thereof; for Plea Say that They are “not Guilty” thereof and for trial put themselves — and the said who prosecutes for the said people in this behalf doth the like— Therefore to try the Issue Joined as aforesaid Let a Jury Come and thereupon the following named persons were mutually elected by the parties. and sworn upon the Jury to wit Jesse Griffitts Joseph <M.> Jones William Robertson William Smith and Joseph Massey— and there not being a Sufficient number of qualified persons to make up the pannel of the Jury by reason of the Challenges of the parties respectively.
