Capture in this wise,— according to the Notice: “Depositions of witnesses, produced, sworn & examined on the [blank]— day of [blank] 1839, between sunrise & sunset of said day, at the office of the Clerk of the Circuit Court of . in the State of , before me, A. B— a justice of the peace within & for the aforesaid, in the case of the State of against . , and Morris Phelps, upon an indictment for , now pending in the Circuit Court of the said State of , on the part of the defendants <>.
[blank] D. C— of lawful age being produced, sworn and examined on part of the defendants deposeth & saith”: (Here the magistrate, witness or someone in presence of the magistrate will write out the statement of witness) which being done the witness must subscribe to his statement, and the justice will annex this certificate)
“Subscribed & sworn to before me, on the day, at the place and within the hours first aforesaid.
A. B— JP.”
And so of the statement of each witness. The taking may be adjourned from day to day but <at least> one deposition or part of one must be taken on each day. The justice will certify the continuance & its cause as want of time or their [p. [1]]
