, Maurice Phelps, and the said other persons (whose names to the jurors aforesaid are as yet unknown) at the county of aforesaid, to wit. at the county of aforesaid to do and commit the felony and murder last aforesaid in manner and form last aforesaid maliciously, wilfully, voluntarily and of their malice aforethought did stir up, move, abet, counsel and procure against the form of the Statute in such case made and provided and against the peace and dignity of the .

5 And the jurors aforesaid upon their oath aforesaid do further present, That the said , Maurice Phelps late of the said county of together with certain other persons to the jurors aforesaid as yet unknown) not having the fear of God before their eyes but being moved and seduced by the instigation of the Devil, on the twenty fifth day of October in the year of our Lord Eighteen hundred and thirty-eight with force and arms at the county of aforesaid in and upon one Moses Rowland in the peace of the State of then and there being feloniously wilfully and of their malice aforethought did make another assault and that the said person to the jurors <aforesaid> yet unknown with a certain other gun of the value of ten dollars then and there charged with gunpowder and one leaden bullet which gun the said person so <to> the jurors aforesaid [p. 7]
