aforesaid feloniously Wilfully and of their malice did kill and murder against the form of the statute in such case made and provided and against the peac[e] and dignity of and the jurors aforesaid upon their oath aforesaid do further present that the said Joseph Smith Junior late of the county of late of the county of and said late of said County of well knowing the said person so to the jurors aforesaid as yet unknown and the said and Maurice Phelps to have done and Committed the said last mentioned felony and murder in form last aforesaid afterwards to wit in the said twenty fifth day of October in the year of our Lord Eighteen hundred and thirty Eight with forc and arms at the County of aforesaid then the said person so as last aforesaid to the jurors as yet unknown and the said and Maurice Phelps did feloniously receive harbor and maintain against the form of the statute in such case made and provided and against the peace and dignity of the .

10. And the jurors aforesaid upon their oath aforesaid do further present that the said and Maurice Phelps late of the county of to-gether with a certain other person to the jurors aforesaid as yet unknown not having the fear of God before their eyes but being moved and seduced by the instigation of the devil on the said twenty fifth day of October in the year of our Lord Eighteen hundred and thirty eight with force and arms at the county of aforesaid in and upon one Moses Rowland in the peace of the State of there and then being feloniously Wilfully and of their Malice aforethought did make an other assault and that the said person to the jurors aforesaid yet unknown with a certain Gun of the value of Ten dollars there and then charged with Gunpowder and one leaden Bullet which gun last aforesaid the said person to the jurors aforesaid as yet unknown in both his hands there and then [p.
