It is hereby stipulated and agreed that the cause of action in this cause be and is hereby assigned to for the use of said , together with , , , & , share & share alike— said to act as the trustee & Controll— Subject to the right of the said Complainant to receive one thousand dollars & the costs herein which he may pay, has paid or shall be liable for, first, Out of the proceeds of the Sales of the property mentioned & described in a Bill & Sup. bill in favor of the vs Et. al, or out of the first proceeds of the sales of the property mentioned in this bill— one hundred and fifty dollars of which has been paid & the balance Eight hundred & fifty dollars is to be paid together with Costs as aforesaid to said Complainant in Consideration of said assignment— out of the proceeds of the sales of the property mentioned in said Bill & Sup. bill of vs Et. al. or this bill, which shall by any decree in said Cause or Causes be Coming to either or all of the defendants in this bill— and said Complainant to Controll this suit until he is paid as aforesaid—
