And now at this day to wit, the 20th. day of September A D 1850 Comes the said Complainant by his Solicitor, and the said Defendants , Elisha Dixon, , & John. M. Ferris having been served with the Summons issued herein on the first day of June A D 1849. And the said Defendants Lewis C. Bidamon, , & had been duly served by publication before the last term of this Court and an order having been entered in this Cause at the last term of this Court requiring the said defendants to answer the Complainants bill filed herein before the first day of the present term of this Court, and said Defendants having failed to answer said bill and being severally three times Solemnly Called come not but make default. It is ordered that the said bill be taken as confessed against the said Defendants, ; & Lewis Bidamon Elisha & , , John. M. Ferris Administrator of the Estate of Joseph Smith deceased, , and . And it further appearing to the Court that the said Defendants , & are infants & had been duly & personally served with the summons herein before the last term of this Court. On of Complainants Solicitor, ordered that Milton. M. Morrill a Solicitor of this court be & is hereby appointed of said infants in this Cause. [p. 270]
