Recorded 23rd. Feb 1848.
This Indenture made and entered into this 21st day of June in the year of our Lord one thousand Eight hundred and forty seven Between as administrator of the estate of Joseph Smith deceased a party of the first part, and of the County of and State of of the second part witnesseth, that whereas the said as administrator aforesaid presented his petiti[o]n to the Circuit Court in and for the County of and state of at the May Term thereof praying a decree of said Cou[r]t for authority to sell the real Estate of which said Joseph Smith dec’d seized of or so much as would pay the debts of said Estate, and whereas at said Term of said Court such proceedings were had on said petition that the said Court made the following order thereon to wit:
On the petition of administrator of the Estate of Joseph Smith decd. for an order to sell the real estate of the said Smith deceased to pay the debts thereof.
Now this cause came on to be heard on the petition & the Exhibits of said , and it appearing to the Court that due notice had been given according to Law by the said of this application & no one interested appearing here in Court to defend the same, It is therefore ordered by the court that said Bill be taken for confessed, And now again came the by his soliciter and the Court having fully heared the evidence, and due consideration being therefore had It is Ordered and Decreed by the Court that so much of the Real Estate of said Joseph Smith deceasd as was his property at his death or at the time of his decease be sold by said Administrator to pay and satisfy the debts now due against said Estate. It is further Ordered and decreed by said Court that the said after having given first four weeks notice thereof by some publication in some Newspaper or in four public places in the County aforesaid shall proceed to sell the same to the highest bidder on a credit of six months, securing the purchase mony by good personal security and a mortgage on the premises
The said Administrator shall faithfully apply the proceeds of such sale to the payment of the debts of the said Estate and file the amount thereof with Court of Probate of said , It is further ordered that the said shall make his report of all his actings and doings in the premises to this Court at the next term till which time this cause stands continued.
