Whereas at the July Term AD 1851 of the Circuit Court of the for the district and state of a decree was rendered in a suit in wherein the were complainants and and heirs at Law of Joseph Smith deceased Lewis C Bidaman [Bidamon] his wife Matthew McClaughry and others were defendants by which decree the sum of $6546.55 was found to be due from Joseph Smith deceased by Judgment to said Complainants. After deducting the amount hitherto made by sale under a former decree rendered in this case and the real estate hereinafter described with other real estate adjudged to be liable for the payment of the said debt and ordered to be sold for the payment of the same. and whereas by said decree, was appointed a Special Commissioner to sell and convey said real estate under said decree first giving due notice of the time place and terms of said sale and of the property to be sold and whereas as such Commissioner I gave due notice of said sale as required by said decree by advertisement of the time place and terms of said sale and of the property to sold by publication in the Warsaw Signal a weekly newspaper printed in the County of aforesaid said publication having been made on the Eleventh day of October and continued for four successive weeks stating in said publication that said sale would be held on the Eighth day of November AD 1851 at said place above named offer for sale at public to the highest bidder for cash, the following described real estate and James McIlvain of Illinois became the purchaser of the same bidding therefor the sum of Twenty dollars & twenty five cents for the first lot the sum of Forty dollars & Twenty five cents for the second lot hereinafter describer (being Sixty Dollars & Fifty cents in the whole which were the highest bids made for the same now therefore Know all men by these presents, that I Special Commissioner as aforesaid acting under said decree in consideration of the premises and of the sum of Sixty dollars & fifty cents to me paid the receipt of which is hereby acknowledged have granted bargained and sold and do by these presents grant bargain sell convey and confirm unto the said James McIlvain his heirs and assigns the following described premises situate in the County of and State of aforesaid Lots numbered one (1) & four (4) in Block number four (4) in the first addition to the town of otherwise called , otherwise called , To Have and To Hold together withall the Appurtenances thereto belonging to him said James McIlvain his heirs and assigns forever Provided however that this deed contains no implied warranty on the part of said , In witness whereof I have hereunto set my hand and seal this 8h day of November AD Eighteen Hundred and fifty one,
