. of lawful age being affirmed to & examined on the part of the Plaintiff deposeth and saith, that some time the fore part of October last came to my <his> house and told him that he had been employed by Joseph Smith and others to go to and make a purchase of some groceries and asked him if he wished to send for some groceries for myself <himself>. he told him he would be pleased to do so. And he let him have thirty Dollars and gave him a bill of Articles, which was one barrel of sugar house Molasses, two hundred pounds of Muscovado sugar, And two hundred pounds of Rice andpack and directed him to pack the same in good substantial barrels and Mark them . when returned to he told him he had purchased the Articles but did not mark them as he had directed him to. In consequence of coming with them himself. and when he arrived in they were forcibly detained suposing they were his property, which he testifies they were not he being duly employed to do the business both for himself as well as others, he now testifies that he has not received anything for the Money so— sent
