of lawful age, being sworn and— examined on the part of the Plaintiff deposeth and saith that some time in the fore part of October last he placed in the hands of , for Joseph Smith the sum of between two hundred and— eighty and three hundred Dollars, in pursuance of a contract or agreement which the said Joseph Smith had made with said to go to to purchase groceries for him the said Smith. the arrangement to send— to between him and Joseph Smith was made in my <​his​> presence at which time he paid over the Money to said at the instance of said Smith And further he says that he was present when and gave to said Money to the amount of near one hundred Dollars which he helped count for which said was to purchase for them family groceries for the use and benefit of their families and further that the sent seven and a half Dollars and twelve Dollars and a half Dollars for the which he also counted
