certify that the deponent, whose place of residence is in the State of Illinois was by me sworn and to testify the whole truth of his knowledge, touching the matter in controversy in the cause aforesaid, and that his Deposition was reduced to writing, and subscribed by him in my presence on the 17th day of May A D 1842 between the hours of eight oclock in the forenoon and six oclock in the after-noon at in the County of Hancock and State of Illinois

, of lawful age being sworn and examined on the part of the Plaintiff deposeth and saith— That on or about the middle of October last heard heard from that he was going to to purchase groceries for Joseph Smith and others and as he was going to himself to spend the Winter he made his arrangements to go in company with him. that in consequence of business said — started a day sooner than he <> was ready to go and that he did not overtake him until he arrived in Mo., near the twenthieth of October last he fell in company with said in and went with him to about the tenth of November he said purchased groceries to the amount of— several hundred Dollars for Joseph Smith and others in Illinois he himself gave him seventeen Dollars and seventifive cents to purchase groceries for his own family living in . he assisted the said in his purchases that they consisted of sugar coffee Molasses and other Articles and that he said concluded inasmuch as he was coming with the groceries himself that [p.
