County of aforesaid afterwards to wit on the day and, year aforesaid at and within the County of aforesaid and State of aforesaid, not having the fear of God before their eyes, but being moved and Seduced by the instigation of the Devil with force and arms in and upon one Joseph Smith in the Peace of God and of the People of the State of then and there being unlawfully, feloniously wilfully and of their malice aforethought did make an assault: and that the said John Wills, William Voras, William N Grover, , , , and one Gollaher, whose first name to the Grand Jurors aforesaid is unknown and one Allen whose first name to Grand Jurors aforesaid is unknown, a certain gun of the value of one Dollar then and there loaded and charged with gun powder and one leaden bullet (which gun they the Said John Wills, William Voras, William N Grover, , , , , and one Gallaher whose first name to the Grand Jurors aforesaid is unknown, and one Allen whose first name to the Grand Jurors aforesaid is unknown, in all the hands of them the said John Wills, William Voras, William N. Grover, , , , and one Gallaher, whose first name to the Grand Jurors aforesaid is unknown, and one Allen, whose first name to the Grand Jurors is unknown, then and there had and held) <to against> and upon the said Joseph Smith, then and there unlawfully, feloniously wilfully and of their malice afore thought, did Shoot and discharge, and that the said John Wills, William Voras, William N Grover, , , , and one Gallaher, whose first name to the Grand Jurors aforesaid is unknown and one Allen whose first name to the Grand Jurors aforesaid is unknown with the leaden bullet aforesaid, out of the gun aforesaid, then and there by force of the gun powder shot and sent forth as aforesaid the said Joseph Smith in and upon the said right breast of him the said Joseph Smith a little below the right pap of him the said Joseph Smith then and [p.
