upon one Joseph Smith in the Peace of God and of the People of the State of then and there being unlawfully, feloniously wilfully and of their malice aforethought did make an assault: and that the said John Wills— William Voras, William N. Grover, , , , and one Gallaher whose <first> name to the Grand Jurors aforesaid is unknown and one Allen whose first name to the Grand Jurors aforesaid is unknown a certain Gun of the value of one dollar then and there loaded and charged with gun powder and one leaden bullet (which gun they the said John Wills, William Voras— William N. Grover, , , , and one Gallaher whose first name to the Grand Jurors aforesaid is unknown and one Allen whose first name to the Grand Jurors aforesaid is unknown in all the hands of them the said John Wills, William Voras William N. Grover, , , , and one Gallaher whose first name to the Grand Jurors aforesaid is unknown and one Allen whose first name to the Grand Jurors aforesaid is unknown then and there had and held) to against and upon the said Joseph Smith then and there unlawfully feloniously, wilfully and of their malice aforethought did shoot and discharge and that the said John Wills, William Voras, William N. Grover, , , , and one Gallaher whose first name to the Grand Jurors aforesaid is unknown and one Allen whose first name to the Grand Jurors aforesaid is unknown with the leaden bullet aforesaid, out of the gun aforesaid, then and there by force of the Gunpowder shot and sent forth as aforesaid the said Joseph Smith in and upon the right Breast of him the said Joseph Smith a little below the right Pap of him the said Joseph Smith then and there unlawfully, feloniously, wilfully and of his malice aforethought did strike Penetrate and wound giving to the said Joseph Smith then and there with the leaden bullet aforesaid, so as aforesaid shot discharged and sent forth out of the gun aforesaid by the said John Wills, William Voras, William N. Grover, , , , , and one Gallaher whose first name to the Jurors Grand Jurors aforesaid is unknown and one Allen whose first name to the Grand Jurors aforesaid is unknown in and upon the said Right Breast of him the said Joseph Smith a little below the right Pap of him [p.
