in manner and form last aforesaid, feloniously voluntarily, wilfully and of their malice aforethought did kill and against the <form of the statute in such case made & provided & against the> Peace and dignity of the and against the form of the statute in such case made and provided— And the Jurors aforesaid upon their othe aforesaid do further present that, <the said> Joseph Smith Junior late of the said County of late of the said County of , & late of the said County of , well knowing the said , NormanShearer , Maurice Philps and the said other persons, (whose names to the Jurors aforesaid are as yet unknown) to have done and committed the said last mentioned felony and murder in form last aforesaid afterwards to wit on the said twenty fifth day of October in the year of our Lourd Eighteen hundred and thirty Eight with force and arms to wit at the County of aforesaid then the said Norman Shearer , , Maurice Phelps and the said other persons (whose names to the Jurors aforesaid are as yet unknown) did feloniously receive harbour and maintain against the <form of the statute in such case made & provided and against the> peace and dignity of the state of and against the form of the statute in such case made and provided
