To the Judges of the Municipal Court of the City of
Whereas <We> , & of said being under arrest illegally, and in the custody of a constable of in said by virtue of a writ issued by a Justice of the Peace for said do hereby apply to the Municipal Court of said , and pray that they may grant them us a Writ of in pursuance of a provision in the City Charter and an ordinance in pursuance of said Provision that we may be entitled to the privilege of showing to your Honors the insufficiency of the writ and the utter groundlessness of the charge preferred in said writ which charges us with unlawfully assaulting and beating one Josiah Simpson at the County of when as we shall be able to prove before your honors that at the time the circumstance alluded to transpired we were in the peaceable pursuit of our own affairs.
