Whereas, at the July Term A.D. 1851 of the Circuit Court of the for the District and State of , a decree was rendered in a suit in wherein the were Complainants, and , , , and heirs at Law of Joseph Smith, deceased, Lewis C. Bidaman [Bidamon], his wife, Matthew McLaughry [McClaughry] and others were defendants, by which decree the Sum of $6546.55 was found to be due from Joseph Smith, deceased, by judgment to said Complainants, after deducting the amount hitherto made by sale under a former decree rendered in this Case, and the real estate hereinafter described, with other real estate, Adjudged to be liable for the payment of said debt, and ordered to be sold for the payment of the same:
And whereas by said decree, was appointed a Special Commissioner to sell and convey said real estate, under said decree, first giving due notice of the time, place and terms of said sale, and of the property to be Sold, and whereas, as such Commissioner, I gave due notice of said sale, as required by said decree, by advertisement of the time, place and terms of said sale, and of the property to besold, by publication in the Warsaw Signal A weekly newspaper printed in the County of aforesaid, Said publication having been made on the Eleventh day of October 1851, and continued for four Successive weeks, Stating in Said publication that said sale would be held on the Eighth day of November A.D. 1851, at the door of the Court House in in said ; and whereas I did on the Said Eighth day of November, A. D. 1851, at Said place above named, offer for sale at public to the the highest bidder for Cash, the following described real estate and the became the purchacer of the same, bidding therefor the sum of twenty dollars for each tract, <which was the highest bid for the same;> Now therefore, know all men by these presents, that I , Special Commissioner as aforesaid, acting under said decree, in consideration of the premises and of the bids aforesaid to be credited on Said decree and of One dollar to me paid, the receipt of which is hereby acknowledged, have granted, bargained, and Sold, and do by these presents, grant bargain, Sell, convey and confirm unto the Said his heirs and assigns, the following described premises, situate in, the County of And [p.
