hindering, delaying or defrauding his creditors, or that the conveyances of said premises as above named by said to Respondants , and was made by the procurement or for the use of <​or​> benefit of said Joseph Smith deceased or that he had any interest therein or that said conveyances were <​so​> made so <​to​> hinder delay or defraud the creditors of said Jo. Smtih deceased, or that said Smith deceased furnished any part of the purchase money for the same or was in any manner personally interested therein.
And Respondants positively state that said qr. section last aforesaid was purchased by said on the part and behalf of and in trust for the Church and society then at aforesaid called Mormons, who were then unincorporated to be held by said , a Bishop of said Church or his assigns for the use of said Community and Church together with Respondants , , and that the purchase money was contributed by and others, members of said Community and Church, to make such purchase for the use and purpose aforesaid.
That at the time of said making said purchase he was acting as the Bishop and agent or trustee of said unincorporated Church and society and took said Bond in his individual name but for the purposes aforesaid.
That afterwards and by reason of some dissatisfaction of said community or Church with said , said without any consideration passing from said Jo. Smith deceased assigned said Bond to said Joseph Smith deceased, to be held by said Smith deceased, in trust for the purposes aforesaid for which the said purchase was made
That said and said Smith dec. while holding said Bond as aforesaid contracted to convey parts of said premises caused the same to be laid out into Lots and Blocks in aforesaid and out of the proceeds of such contracts for sale of parts of said premises and of contributions afterwards made by other member of said Church and Society for the purchase thereof and not out of moneys contributed or paid by said Joseph Smith deceased the balance of the purchase money for said premises was paid to said by said one and others acting for and on behalf of said Church and Society, and the title thereto by their procurement and by the consent of said Joseph Smith deceased who held said Bond in trust as aforesaid, and not by the procurement of said Jo. Smith deceased, was conveyed by said to said to be held by said for the use and benefit and interest for said unincorporated Church and society and said Respondants , , and ,
