The Court also decided in the case of this witness that it was in the discretion of the Court to permit a witness after he has been examined in chief by the the Plffs Attny, although not cross examined by the Defts counsel to be recalled and again interrogated as to other facts by the Attorney for the prosecution. That the Court ought not to permit such reexamination to be too frequently repeated but as such had not been the case in this instance the witness might be recalled and reexamined as to any material facts not already testified to. The remarked further remarked that it was a privilege which he would not refuse to the Defts counsel under like circumstances and which he ought not to withhold from the prosecuting merely because the witness had not been cross examined— [1/3 page blank]
