I was in , and at the Rail Road and at home they day the Smiths were killed— I was in in the morning and left there with the companies— left to go to “”— I think it is probable that I saw a part of the Defendants at that morning— Cant Say that I saw all of them— Came out with ’s Company to the Rail Road Shanties— The troops were disbanded by at the Rail Road Shanties— thinks read the order to disband them, as well as he recollects— after the troops were disbanded— it would be impossible for me to tell what I heard that day— did not hear make a speech that day— heard a call made for Volunteers— but cant say who made it— I was in bad health that day and did not expect to be called on as a witness— Saw and there— Dont recollect to have heard make a Speech— I saw there— Cant say that I know that a company started this way— may have seen some start— I was [blank]— there were some Shootings at a mark— might have heard Some one say, but cannot recollect who about going to that day— It was spoken off around among the crowd— I heard a disputing about who would, or who would not go to that day— I heard say that “all those who are in favor of and taking dinner at the tavern”— he was for the dinner— It was something to that effect— as to the cause of the dispute— it was that some seemed to be in favor, and others not of coming to — it was <not> understood distinctly what they were to come to for— thinks there was something said about the Smith’s but cant [p. 43]
