but did not hear him say a word— did not ride either a black or white horse— might have been sorrel or bay— there were baggage waggons along— Saw one baggage start this way— dont know whether there was any other or not— Mr. Fultz was driving this the waggon that came this way— there might have been two or three other baggage waggons— dont know whether the men who came towards put their arms in the baggage waggon or not— this occurred about 12 Oclock the 27th. of June 1844, was there on a horse, no <knows> nothing about his having a baggage waggon there— This was at the Railroad Chanties lived South west from there— lived in , and was about East from there—
I am not positive that Smith was murdered on the 27 June 1844— but on the day Jo Smith was killed— Saw Col. — Mr. [William] Grover— at different places— at , at the Rail road Chanty’s <and [blank] >— cant say positively about <Seeing> — cannot say that he saw — heard [p. 6]
