Say I was in one of the advanced companies some half a mile before the rear companies— came up to the advanced company and Said that had stated that he had done all the law enabled him to do for them— and mentioned something about the Situation of the old citizens— he mentioned something about coming to — dont recollect that he asked me to come along— there was a call made for volunteers— do not recollect who made the call— did not see any of these men at the time— did not say who was coming to — heard Say something that he be damned if he was going to to kill a man who was confined in Prison— cant identify who the individuals were who were present <thinks [Richard] Woodworth, his brother <and> Eli [D.] Walker and> [Hampton] Loftis and Some others— heard Grover say nothing about it— saw a number of men going towards but cant identify them— dont did not hear any considerable number say any thing about killing Smith— dont recollect any one— witness went home— went towards — thinks was riding a bay mare— cant State the number of baggage waggons— a half dozen at least— did not know — and did not see him there that day— did not see any baggage waggon there belonging to to his knowledge— [p. 7]
