I never heard either either before or after the killing the Smith that they had anything to do with it— I heard that it said by drunken lofers and do not believe that the defendants knew nothing about it
I was Capt and had been during the excitement here there were 20 to 30 men I have my com[mission] from — I knew of no arrangement between the Carthage Grays and the mob to kill Smiths— It has been intimated to me that the mormons— I was I saw three groops of men coming from towards I thought on the road I do not know whether either of the Def[endan]ts made pledges to the gov to protect Smith in custody I know there were pledges made but do not know that Defts were present when I saw the men they were about 4 miles from they were coming rapidly [1/3 page blank] [p.
