what he Said as to when or how they afterwards left the men— He Stated that he was said to be a Carthage Grey, not from the knowledge that he had of him, but he was told by another person— I think he stated that he saw and Henry Stevens [Stephens] conversing with this man who was said to be a Carthage Grey— this is according to my recollection— I dont recollect that he stated that any of these men passed him 3 or 4 miles from here on his way back to — He Said he rather thought that the horse was riding was a sorrel— Dont recollect that he said that he Saw riding such a horse at the day before— it may be that he said he saw riding such a horse at the Shanties— I did not understand to say that he inferred from what he had seen before or after that it was <he saw> at the Jail— He first stated that it <he> was about 1/2 mile from the Jail when he first saw — He afterwards stated when interrogated by the Jury as to how he could See at So great a distance from the jail what was going on— that it might be a quarter of a mile— or between 1/4 and 1/2 a mile—
I think he stated that Mr. [William] Grover— Mr. [John] Wills— Mr. [William] Voras and Mr. Galliher[Gallaher], came out from the Jail and got into his waggon— thinks there was something Said by him of the name of James Gregg, who came by and passed him— thinks he Stated that some individual— but dont recollect that it was one of the Chittendens— told him to put out a part of his baggage and returned back— the memorandum I spoke of, was made after the grand jury had adjourned— I am now enabled to speak more certainly from this memorandum, than if I had depended entirely on my recollection— I think most of his Statements which I heard him make on yesterday, corresponds pretty generally with what he Said before the Jury— I think he Stated yesterday that Voras & Galliher, did not get into [p. 75]
