<Sunday 17 Decr.> Mr. one of the Constables of , started with ten men this p m <afternoon> to arrest <for kidnapping ,> upon a warrant granted by Esqre. Esqre. J.P.
<18> After dinner— returned with <a Schoolmaster> when an examination was had before in the Assembly room— was found guilty of kidnapping <> and bound over to the Circuit <County> <Circuit> Court <at > for trial, in the sum of $3,000— <I suggested to<endeavored to have> the court the propriety of reducing <reduce> these bonds, as was comparatively a stranger in — but did not succeed—>
During the investigation testimony appeared to shew that had threatened my life, & for this, I made affidavit, & brought him to trial before J.P. immediately after he had received the sentence of , I extract from the Neighbor (see 134 & 135 The prisoner (to) themselves”
<θ> about 10 p m Two young men arrived as express from , stating that a Mob was collecting at , also at Col house; & Messengers had gone to Miss. the Mob in to reinforce their number there— <*>
I received from Esqre <Esqre. the following> made a demand <Sir (Copy)> on me, as the Mayor, for a posse, to send to ’s assistance, whom he had sent this afternoon with a warrant to apprehend as being concerned in the kidnapping of , which demand I complied with by writing to Maj Gen (Copy) Mayor and also wrote to Major Gen Sir (Copy) Mayor
<*> Dr. made the following affidavit “State of (Copy) Court” <whereupon I>
who detached Col with 10 men for that purpose <θ>
I returned home to rest about one o clock in the morning of the 19th.
<Tuesday 19> at home— About 9 a m a part of the Company who went with returned, & stated that they went within two miles of ’, when they were informed that a body of men <armed with rifles &c were> collected around him <at his house>, & he judged it prudent to return for weapons & help: also that bro told them, that he had seen 30 armed men following Constable , some miles on his way when he had charge of in custody.
<“<*> I directed my clerks to ma <make> copy <copies> the affidavits respecting the kidnapping of the Averys to send to ; that he might be left without excuse altho he may <probably> not read them.>
