I went to Mr. Fullers— I got there not far from 12 oclock at night— Some of these men were then in and some were coming— Fuller follows teaming— dont know where the men went that night— Saw a few of them that night— I did not drive by the Warsaw House (Mr. Flemings) but drove up near to it— Saw 20 or 30 persons about the Warsaw House that night— I did not go in the House— did not see any of the Defendants that night after I got back to — Never saw them that night after they passed me a short distance from — knows a man by the name of Gregg— he lived in then— dont know where he lives now— he was the first who brought the news that the Smiths were killed— Said both of them were killed— said nothing about the Carthage Greys being concerned in the Conspiracy— Knows nothing of a call being made at the Rail road for all to step out who would go to — when they left the waggons before they got to they went to the left coming this way towards the timber— I afterwards saw them coming up out of the timber towards the jail—
Cross Examined
heard no speech made at the Rail road crossing— — — and were all on horseback— rode a sorrel mare— this was before I came to those same three men passed me afterwards as I was on my way back to — believe they were on horseback going back— they were stringing along, but cant say which was ahead— Grover was in my waggon at that time— forget whether either of them spoke to Grover or not as they passed— it was [p. 63]
