whether Galliher did or not— dont recollect that I Saw Galliher until I got to — he was a foot— other men were along— 5 or 6 or <men> got into my waggon— two of the Chittenden’s and Grover & Wills got in— all I recollect now— I dont think I Stated to the Grand Jury that Voras and Galliher got into my waggon— Saw Galliher in main street in next day— dont think I saw him that night— when Grover got into my waggon he was talking to about killing the Smiths— Grover told me <Some one in the waggon> that he was the first man who went into the Jail— and that Jo Smith struck him twice in the face— he Said nothing about — thinks he Said Jo Smith had a pistol— did not say why Jo did not shoot him instead of striking him with <his> fist— did not hear him Say what Smith did with his pistol— said he never knew prisoners to be put into Jail before with arms— I rather think he said pistol and arms both— I forget whether Capt. Grover had a sword on that day— or not— think he had not— I have forgot whether any of the officers had Swords or not that day— my recollection is not very distinct of the events of that day— recollect that I felt very nice myself— I forget whether I Stated to the Grand Jury, that Grover said that Smith had struck him twice in the face, but that he had got revenge for he had thrown him out of the window— I do not now remember that Capt Grover Said he threw Smith out of the window— From the position I occupied I could not have seen Smith fall out of the Window— Thinks it was betwixt 4 and 5 O’clock when I started back to — [p. 67]
