I was driving a two horse waggon with two horses— It is called 11 <15> miles to — from — after I stopped my waggon 1/4 or 1/2 mile from the Jail— came by— Mr. Cole’s waggon— there were about 5 or 6 persons in the waggon— thinks Cole was driving the waggon, butt am not sure— whether he was or not— know who were in the waggon at that time but have forgotten except Cole, & , and thinks a man by the name of [Robert] Johnson but am not sure— The persons who were in Cole’s waggon had not been with the troops after they left the rail road crossing— they did not stop when they came up to my waggon— but they did not go a great ways by me before they did stop— they made no inquiry as they passed me— they did not go to the jail at all— They were firing at the time Cole’s waggon passed by mine— The firing had commenc[e]d at the Jail before they passed— dont know how many came up out of the woods and went to the jail— thinks <about> 50 or more— The first firing I saw was at the jail— I Saw them as they came up by the fence from the timber to the jail— saw nor heard no firing until I heard the firing at the Jail— I Saw the smoke of the guns at the Jail as Col passed me— the smoke I Saw was outside the Jail— could see no light at the Jail— the men I Saw firing were at the South end of the Jail— dont know what they were firing at— Grover did not say how he got loose from Smith— [p. 68]
