He was not talking very loud, about as loud as you () are talking now— I was along about in the middle of the Company— they were not marching in regular order— dont know who it was that told me that he was a Carthage Grey— I recollect Seeing because he had feathers in his hat— Saw Grover also talking to him— Saw the Carthage Grey start back towards — he was on horseback— I forget whether any one went with him, or what was the color of the horse he rode— thinks it was an iron gray or roan horse he road— I had something to drink that day— and had taken enough to make me feel nice. Dont recollect that I told the grand jury that the Carthage Grey was riding an iron grey poney— Dont recollect whether it was right at the time the Carthage Grey left or a little after that the men left the road— Burton and Hoten were with me driving waggons—

Saw no more of the troops until I got near — when I saw them coming up through the timber— we halted about 1/4 of a mile from the Jail— the troops came up within a half a mile of us— the troops was as near to us when they were at the Jail as they were at any time after we had separated— thinks it was nearer 1/4 then 1/2 mile where we halted— did not see Grover go to the jail— saw a man at the Jail appeared to be hunting something— he said it was him hunting his gun— a double barrel Shot gun— Did not See , or at the Jail— Dont think I Stated to the Grand Jury that I Saw — [p. 65]
