their guns— Saw Jo. Smith when he fell from the window— I was out in the middle of the road— East of the Jail when he fell— the crowd was between me and the Jail— I think he was not Shot when he fell— but do not know but think he was not— they lift him a very short time after he fell— there there were two or three or may be more of guns fired after he fell— there was considerable firing— did not See nor about the jail that day— nor — Saw Mr. Grover there running towards the door of the Jail before the killing— when they were first approaching the house house. Saw up towards the jail that evening— did not see him when I first went there— First I Saw of he was right there— on this side the jail in the middle of the road— cant did not see from which way he came there. The Carthage Grays stood this side the Jail— was between the Carthage Grays and the Jail. Saw before they fired any— they had not gone into the house before I Saw him— they came up to the jail— they did not surround <it—>— Saw Grover afterwards about the jail— he was armed with a double barrel shot-gun— dont recollect whether I heard Grover [p. 20]
