The evidence to sustain this allegation is as follows.
The title to the N. W. fractional quarter of section ten (10) 7 N 8 W. is deduced as follows,
to George Robertson deed dated April 30. 1839, George Robertson to Joseph Smith deed bearing date March 24, 1841.
The title to South West fractional quarter of section 19, 6 N 8 W. is deduced by deed from to George Robertson dated April 30, 1839, and by deed from George Robertson to Joseph Smith dated March 24 1841.
The title to South East quarter of section 26, 7 N 8 W is deduced by deed from Benjamin Clark to Thomas G. Little dated May 22, 1840, by deed from Thomas G. Little to Ethan Kimball dated May 27, 1842 by deed from Ethan Kimball to Joseph Smith date June 20. 1842.
The title to the South West quarter of section twenty five 7 N, 8 W, is deduced by deed from the of Illinois on tax sale to bearing date June 15th. 1842 by deed from to Ethan Kimball bearing date June15, 1842 by deed from Ethan Kimball to the said Joseph Smith dated June 20. 1842.
The title to the East half of the North East quarter of section thirty five 7 N 8 W is deduced by deed from Benjamin Clark to Thomas G. Little dated May 22, 1840 and by deed from the said Thomas G. Little to Ethan Kimball dated May 27 1842 and by deed from the said Ethan Kimball to the said Joseph Smith dated June 20. 1842,
It was proved before me by the oath of District Attorney of the that the deeds and title papers above mentioned are not in the possession or power of the said , so that they can produce the same upon this hearing,
And it was proved before me by the Oath of George Edmunds Jr. that the abstract above set forth of the title to the lands above described was taken from the records of the recorder’s Office in Illinois, where said deeds are recorded, and that he examined and compared the said [p. 644]
