And now at this day to wit, the ninth day of July in the year last aforesaid, comes the complainants by their District Attorney, and it appearing to the Court that Luke Wood one of the defendants in the original Bill in this cause was duly served with summons returnable to the February rule day 1851, and that he has failed to appear, plead, answer or demur to said original bill.
And it further appearing to the Court that John J. Brent, Frederick R. Prentice, John Smith, , Leonard F. [T.] Ferris, Hick[i]son Wright, James Ward W. Ward, J[ames] McIlvaine, Matthew McClaughery [McClaughry], J[ames] Richardson, F. Wooley [Fitzgerald Woolley] and J. [Isaac] R. Welch thirteen of the defendants in the said supplemental bill named, were during |the months of March and February A. D. 1851 duly served with summons in this cause returnable to the May Rule day A. D. 1851 to appear, plead, answer or demur to the said original and supplemental bill and they having severally failed to appear, plead, answer or demur to the said original and supplemental Bills or any part thereof, and the said several defendants herein before mentioned being now three times solemnly called come not but make default andno and no cause appearing to the contrary.
It is ordered, adjudged and decreed that the said original bill and the matters therein contained and stated be and the same is hereby taken as confessed as to the said defendant Luke Wood, and it is further ordered and decreed that the said original and supplemental bills and all the matters therein contained and stated be and the same are hereby taken for confessed as to the said John J. Brent, Frederick R. Prentice, John Smith, , Leonard F. Ferris, Hickson Wright, James Ward, W.Ward, J. McIlvaine, Matthew Mc Claughery, J. Richardson, F. Wooley, and J. R. Welch and as to each and every of them.
And it further appearing to the Court, that , E. Morrill, A. W. Williams, J. Moyall, A[mos] W. Condit, W. W. Noyse, and E. W. Turner cannot be found in the District.
On motion of the complainants, it is ordered [p. 659]
