that the said original and supplemental Bills be and are hereby dissmissed as to the said seven persons last named.
On motion of the complainants’ counsel it is further ordered that the said original bill as to the interest of said defendant Luke Wood, and the said original and supplements bills as to the other defendants in this decree named be and the same are hereby referred to who is hereby appointed in this cause a special commissioner and master of this Court to examine and report herein at this term of this Court.
It is further ordered that George W. Meeker a solicitor of this Court be and is hereby appointed Guardi[a]nadlitem for , , and infant defendants, to take care of their interests in the premises.

And now this day, to wit, the eleventh day of July in the year last aforesaid, comes the defendant Joshua Ward by his solicitors, and on his application leave is hereby given to the said Joshua Ward to take the deposition of Mrs. one of the defendants in this cause to be used by the said Joshua Ward in his defence herein, subject to all legal exceptions.
This day, to wit, the day and year last aforesaid came the Special Master appointed herein and filed his report.
Special master of said Court to whom was referred certain matters in litigation between the parties to this cause, having examined the original and supplemental bill herein, and the answers, disclaimers, , exhibits and evidence upon the files of the Court in this Cause and also witnesses produced and sworn before him begs leave to report as follows to wit:—
That by the judgement and consideration of the common Law side of this Court, the did on the 11th. day of June 1842 recover the sum of $486638/100 debt and 31793/100 damages together with costs, taxed at $4196/100 against the said Joseph Smith since deceased and , , and in a certain [blank] of debt then and there pending between the said parties as by the record of the said suit remaining in the said Court fully appears an exemplification of which was exhibited to me upon the hearing of the matters referred to me as aforesaid.
