Also lots one, two and four (1, 2 and 4) on Block nine (9) claimed by the defendant Matthew McClaughry under said deed
Also lots 2 and four on Block 12 claimed by J[ames] Richardson, defendant herein under said deed.
All of Block twenty one claimed by the defendant F. Wolley [Fitzgerald Woolley] under said deed.
Also lots one and four on Block twenty three claimed by the defendant J. [Isaac] R. Welch under said deed.
All of said Lots and Blocks in the town of Macedonia or Webster aforesaid.
Also lots 2 and 3 in Block one (1) in the first addition to said (now Webster) claimed by said defendant W. Ward under said deed.
All of said lots situated in the County of , State of aforesaid.
It was further proven by said witness that these are upon the records of the Recorder’s Office of aforesaid deed purporting to convey to said Joseph Smith decd as such Trustee aforesaid, more than ten acres of land situated in said aforesaid, which deeds were made and recorded prior to the dates of the deeds aforesaid to said Joseph Smith deceased which lands so conveyed to him had not been conveyed by the said Smith, prior to said conveyances to said Smith of said other lands and lots as above herein named as appears by the records of said .

This day to wit the fourteenth day of July in the year of our Lord one thousand eight hundred and fifty one, on motion of G[eorge] Edmunds Jr. solicitor for the defendants Elisha Dixon, , , and ordered that the said defendants have leave to take the deposition of one of the defendants herein as a witness to be used in evidence on their part subject however to all legal exceptions to the same.
