with all of said community and church, the said community and church procured the said to make the conveyance aforesaid, for which they paid said a valuable consideration and Respondants deny that said conveyance was made upon any other consideration or with any other intention or understanding or that said Joseph Smith deceased had any intent whatever therein, or that it was made to hinder, delay or defraud his creditors or for any other fraudulent purpose.
Respondants further admit that said , and now hold the said premises conveyed to them as aforesaid by said .
Respondants admit that in the year A. D. 1839 one was the owner of the South East qr. of section No. two in township no. six North of Range no. nine West in said Bill of Complaint mentioned, that about the 30th. day of April A. D. 1839 said contracted to convey the same to one by bond of that date, they conveyance to be made to said or assigns upon the payment of certain moneys therein named to be paid, that afterwards and about the year A. D. 1840, said assigned said Bond to said Jo. Smith deceased.
That afterwards and in July A. D. 1841 said conveyed said premises to one .
That after the making of said Bond and before the making of said deed as aforesaid said qr. section had been laid out into town lots and blocks in aforesaid.
That afterwards and about July A. D. 1841 said conveyed a part of said qr. section to wit:
Block No. 155 in to Respondant , also a part of said qr. sec, to wit: —
Block 156 in except the ground on which the now stands to Respondant , and also all the balance of said qr. section to Respondant .
But respondants positively deny that said Joseph Smith Dec procured said to make said purchase of said or that he furnished the purchase money or any part thereof, or that said Jo. Smith deceased ever paid any part of the purchase money for said qr. section, either directly or indirectly or that said purchase was made for his use and benefit or that said several conveyances were made to hinder, delay or defraud his creditors or for any other fraudulent purposes or that said Bond was assigned by said to said Smith deceased as before mentioned for the use of said Jo. Smith deceased or upon any consideration paid by said Smith, or that said conveyance of said premises by said to said was for the use and benefit of said Joseph Smith deceased or by his procurement for the purpose of [p. 517]
