Day Saints, that said pretended conveyance was made without there being sufficient parties competent to contract, without consideration and is absolutely void, as to the creditors of the said deceased.
That said pretended conveyance was made in the year A. D. 1842 and after the judgement aforesaid was rendered in favor of your Orators, against said Smith deceased and others, and for the purpose of hindering, delaying and defrauding your Orators in the collection of their said debt,
That afterwards said Joseph Smith deceased in his pretended capacity of Trustee attempted to convey in divers parcels and to divers persons parts of said premises but in what parcels or to whom said pretended conveyances were made your Orators cannot state.
That afterwards and since the death of the said Joseph Smith deceased the said defendant in the name of and also in the name of has made divers pretended deeds by attempting to convey parts of said premises to divers persons, but in what parcels or to whom said several pretended conveyances were made your Orators cannot state.
And your Orators charge that said pretended conveyances by said Joseph and to said Smith as trustee, by said Smith as such Trustee to individuals and by said to individuals were severally made after the renedition of your orators said judgement and with a full notice thereof, and in fraud of the rights of your Orators and with intent to hinder, delay and defraud your Orators in the collection of the same
That said Bond of to and assignment to Smith and said deed to and said deeds from to said , and defendants as above stated and said pretended deed from said Joseph and to said Joseph Smith as trustee were duly recorded in the Recorders Office in Illinois, and were together with the said acts of said Smith, sufficient to put the said defendants on inquiry and that upon such inquiry said defendants would have found that the said premises were the property of the said Joseph Smith deceased.
